2.2 Eligibility. You must be 18+ or the age of majority in your jurisdiction, or have verifiable parental/guardian consent if under 18. You affirm you are legally permitted to use TME under your local laws.
3.1 Updates. We may update these Terms and any integrated policies at any time. Changes become effective upon posting with an updated “Last Updated” date. Continued use constitutes acceptance.
3.2 Service Changes. We may change, suspend, or discontinue features, content types, pricing, or access to portions of TME for maintenance, compliance, or operational reasons.
4.1 Registration. You must provide accurate information and update it when necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
4.2 Prohibited Account Conduct. Multiple or fake accounts to manipulate Credits/Points or features are prohibited. We may suspend or terminate accounts engaged in fraud, abuse, or violations of these Terms.
4.3 Account Recovery. You must promptly notify us of unauthorized use. We are not liable for losses arising from unauthorized access that results from your failure to secure credentials.
5.1 Prohibited Activities. You agree not to: (a) violate any law; (b) upload or distribute harmful, defamatory, obscene, hateful, or infringing content; (c) impersonate others or misrepresent affiliation; (d) circumvent security or access restrictions; (e) scrape, harvest, or mine data without consent; (f) manipulate Credits/Points, boost metrics artificially, or operate farms; (g) share or resell accounts, tickets, or access credentials; (h) engage in spam or malicious code injection.
5.2 Enforcement. Violations may result in content removal, credit clawbacks, publishing freezes, suspension, bans, and/or referral to authorities. See Article 13 (Enforcement & Remedies) for details.
6.1 Platform IP. TME’s software, branding, trademarks, and all platform materials are owned by CrownThrive LLC or licensed to it. You may not copy, modify, distribute, or create derivative works without authorization.
6.2 Your Content. You retain ownership of content you upload. By submitting content, you grant CrownThrive a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, distribute, promote, display, and adapt your content across TME for service delivery and promotion. Additional ecosystem uses are governed by the Creator License Addendum (Article 11).
6.3 DMCA and IP Claims. If you believe content infringes your rights, contact copyright@crownthrive.com. Provide all required DMCA details. We may remove or disable access to allegedly infringing material and may terminate repeat infringers.
7.1 Privacy Policy. Our Privacy Policy describes what data we collect, why we collect it, and how it is used and shared. We do not sell personal information. We use service providers under strict agreements.
7.2 Data Rights. You may request access, correction, portability, or deletion of your data as permitted by law. Contact privacy@crownthrive.com.
7.3 Cookies and Tracking. We use cookies and similar technologies to operate TME, remember preferences, and improve features. Consent mechanisms are provided where required.
7.4 Cross-Platform Sharing. See Article 12 for full details on data sharing and controls across the CrownThrive Ecosystem.
8.1 Nature of Credits and Points. Credits are an internal utility used to publish, boost, and access features within TME. Credits have no cash value, are non-transferable, and are not redeemable for currency. Points measure engagement and reputation and cannot be spent.
8.2 Purchase Rate (Clarity). We may offer a purchase rate (for example, 1 USD per 1 Credit) to acquire Credits for use within TME. This is a purchase convenience, not a redemption promise. There is no cash-out.
8.3 Issuance and Supply. Credits may enter circulation via purchases, limited-time grants (e.g., new user welcome), and event rewards. We control issuance to protect economic stability and may adjust grant sizes, faucet rates, or sinks to manage inflation/deflation.
8.4 Sinks (Spending). Credits are spent on publishing content, boosting visibility, unlocking premium tools, and accessing exclusive events. Prices may vary by media type, duration, capacity, and demand.
8.5 Publisher Accruals. When viewers spend Credits on eligible content, the Publisher accrues 70% of those Credits back to their TME account, reusable for publishing, boosting, or tools (no cash-out). The remaining 30% sustains moderation, security, hosting, rewards, and platform operations.
8.6 Transparency and Change Log. Adjustments to issuance, sinks, or pricing are recorded in a public change log with dates and summaries.
8.7 Abuse and Clawbacks. Credits obtained through manipulation, fraud, or policy violations may be reversed. See Article 13.
9.1 Tiers. TME may offer tiers such as Starter, Pro, and Headliner. Tiers define posting limits, boost multipliers, analytics depth, AdLuxe promotions, and moderation priority. Details may evolve and will be posted in the publisher policy page and/or change log.
9.2 Typical Credit Costs. Illustrative ranges: Standard Post (25–50 Credits), Video Upload (75–150 Credits), Boost (10–250 Credits), Premium Tools (varies), and AdLuxe Sponsored Slots (tier-dependent). Actual pricing may change based on performance, demand, and infrastructure costs.
9.3 Non-Refundability. Credits and subscriptions are generally non-refundable. See Article 10 for limited reissue scenarios.
9.4 Anti-Gaming. Artificial engagement, bot traffic, or coordinated manipulation is prohibited and may result in credit removal, freezes, or bans.
10.1 Payments. Authorized purchases of Credits are processed by compliant payment providers. You agree to pay all fees and applicable taxes. Chargebacks may lead to account holds or termination.
10.2 Refunds. Credits are non-refundable, except where required by law or as part of a verified platform incident (e.g., duplicate charge, failed unlock, extended outage). Approved reissues are provided as Credits to your account.
10.3 Event Refund Logic. If a host or TME cancels an event, viewing Credits are automatically returned. If a verified technical outage prevents access, a one-time access Credit or equivalent reissue may be provided. Refunds are not granted for AUP violations, unauthorized sharing, or restreaming.
10.4 Fraud Prevention. We may suspend accounts for payment abuse, confirm identity, or limit purchases to protect users and the platform.
11.1 Ownership. You retain ownership of your uploads. By uploading, you grant CrownThrive a worldwide, royalty-free, sublicensable license to host, reproduce, distribute, promote, display, and adapt your content across TME for service delivery and promotion.
11.2 Ecosystem Use. To spotlight creators and events, CrownThrive may feature your content across the ecosystem (e.g., Melanated Voices TV, Locticians TV, CrownThriveU, AdLuxe). This includes promotional clips, previews, or derivative marketing materials with attribution using your chosen display name or brand handle.
11.3 Non-Exclusivity. TME does not require exclusivity unless specifically contracted under a separate media or partnership agreement. Exclusive terms, if any, will be set forth in a signed addendum.
11.4 Moderation and Compliance. All content is subject to the Acceptable Use Policy and applicable laws. We may remove or restrict content that violates rights or policies, and we log enforced actions for transparency.
11.5 Takedowns and Termination. You may delete content or close your account. We remove content from active circulation within a reasonable period (typically 30 days). Previous promotional or derivative uses made during the license term may continue for archival and continuity purposes.
12.1 Purpose. TME exchanges limited data with CrownThrive services to provide unified profiles, loyalty rewards, analytics, promotions, and ticketing. We do not sell personal data.
12.2 What May Be Shared. Profile data (display name, handle, avatar); engagement aggregates (views, likes, credit interactions); rewards/tiers; anonymized advertising metrics. We do not share payment methods or private messages.
12.3 Where Data Flows. CrownLytics (analytics), CrownRewards (loyalty), AdLuxe (anonymized ad metrics), ThrivePush (campaigns), CrownThriveU (education), Collab Portal (creator collaborations), and ThriveTickets (events).
12.4 Controls. In Account Settings → Data Controls, you can toggle data sharing per platform, download your shared data, and request deletion from CrownLytics/CrownRewards (processed within a reasonable period, typically up to 30 days, subject to legal holds).
12.5 Retention and Security. Engagement history for active accounts may be retained for up to 24 months; after account closure, we generally delete within ~90 days unless law or legitimate interests require otherwise. Anonymized analytics may persist.
12.6 Third-Party Processors. We only use vetted providers under data processing agreements meeting GDPR/CCPA and industry standards such as ISO/IEC 27001. Ad metrics are anonymized and aggregated.
12.7 Incident Response. In the event of a qualifying breach, we notify affected users as required by law and implement mitigation per our security program.
13.1 Graduated Enforcement. Based on severity and history, we may issue warnings, remove content, revoke Credits obtained through violations, freeze publishing, suspend accounts, or issue permanent bans across the Ecosystem.
13.2 Credit Clawbacks. Credits earned or used in violation of these Terms (e.g., manipulation, farms, fraud, prohibited content) may be reversed without refund.
13.3 Appeals. You may appeal enforcement actions by contacting support within seven (7) days. Provide context and evidence for review.
14.1 Integrations. TME may link to or integrate third-party tools or content. We do not control or endorse third-party practices and are not responsible for their terms or privacy policies.
14.2 Your Responsibility. Review third-party terms before use. Your interactions with third parties are solely between you and them.
15.1 No Warranty. TME is provided “as is” and “as available.” We disclaim all warranties (express, implied, or statutory) including merchantability, fitness for a particular purpose, and non-infringement.
15.2 Service Interruptions. We do not warrant uninterrupted or error-free operation. We are not responsible for data loss or harm caused by third parties, the internet, or events beyond our control.
15.3 Limitation of Liability. To the fullest extent permitted by law, CrownThrive and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility. Our aggregate liability shall not exceed the greater of: (a) amounts you paid to us in the 12 months preceding the claim, or (b) one hundred U.S. dollars (US$100).
15.4 Some Jurisdictions. Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the maximum extent permitted.
You agree to indemnify and hold harmless CrownThrive LLC, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (a) your content; (b) your violation of these Terms or applicable laws; (c) your misuse of TME or ecosystem services.
17.1 Our Rights. We may suspend or terminate your account at any time for violations, fraud, or risk to users or the platform.
17.2 Your Rights. You may terminate your account by contacting support. Upon termination, access ends and content may be removed from active display; certain archival or derivative promotional uses may persist per Article 11.5.
18.1 Governing Law. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules. Venue shall be Pittsylvania County, Virginia, unless arbitration applies.
18.2 Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally with us for at least thirty (30) days.
18.3 Arbitration and Class Action Waiver. Except for claims that qualify for small claims court or claims for injunctive relief, disputes shall be resolved by binding arbitration administered by a reputable arbitration provider. You and CrownThrive waive the right to a jury trial and to participate in class actions or class-wide arbitration. Opt-out: You may opt out of arbitration within 30 days of first acceptance of these Terms by emailing legal@crownthrive.com with subject “Arbitration Opt-Out.”
19.1 Roadmap. CrownThrive intends to expand its CHLOM™ compliance and decentralized governance by 2030, leveraging DAL (Decentralized Audit Ledger) and DLA (Decentralized Licensing Authority) to increase transparency and user controls.
19.2 No Retroactive Reduction of Rights. The CHLOM transition will not retroactively reduce your rights under these Terms. Policy updates will be posted with timestamps and plain-language summaries.
19.3 Participation. If we introduce governance participation features, your involvement will be optional and consent-based, with clear instructions and disclosures.
20.1 Accessibility. We strive to support accessible experiences and welcome feedback at accessibility@crownthrive.com.
20.2 Minors. If you are under 18, you affirm you have parental/guardian consent and will use TME in accordance with our policies.
20.3 Safety. If you encounter content that violates law or our policies, report it through in-product tools or contact support immediately.
21.1 Entire Agreement. These Terms, including the integrated policies in Articles 8–12 and any linked policies (Privacy Policy, Acceptable Use Policy, Community Guidelines), constitute the entire agreement between you and CrownThrive regarding TME.
21.2 Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
21.3 Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations as permitted by law.
21.4 Force Majeure. We are not liable for delays or failures due to events beyond reasonable control (e.g., natural disasters, outages, war, regulatory actions).
21.5 Notices. We may provide notices via the TME site/app, email, or your account dashboard. You agree to keep your contact information current.
